NLVA Spotlight

The Mass Torts Vendor Association is always seeking new ways to elevate its value to members and to the attorneys we serve.  Most recently, the MTVA Advisory Working Committee recognized the need to create enhanced “Requirements and Standards” for the Case Acquisition category of membership. This came as a result of concerns shared at an MTVA full membership meeting in Las Vegas in October of 2021. The MTVA met again on the matter at the January 2022 Trial Lawyers Summit in Miami, Florida. At this meeting a committee was formed to create enhanced “Requirements and Standards” for the Case Acquisition category. After several sessions and confirmation at the MTVA full membership meeting in Las Vegas this month, the following enhanced “Requirements and Standards” were finalized:

1. The member company shall not make false or unreasonable claims, promises or guarantees.
2. The member company's rates and terms are to be clearly identified, accurate, and not misleading.
3. The member company shall not sell or guarantee retainers, dockets, cases, or clients and must keep clear of non-lawyer fee splitting rules.
4. The member company shall take reasonable efforts to comply with ABA advertising guidelines.
5. The member company shall conduct due diligence on all media and lead sources.
6. The member company shall make reasonable efforts to comply with the TCPA.

The MTVA has also decided to embark on creating enhanced “Requirements and Standards” for all membership categories.  The categories of Law Firm Capacity and Client Logistics will be the next areas of focus.  Committees will be formed for each of these categories within the membership of the MTVA and the important work will begin.
